1. Introduction
1.1 These Terms and Conditions ("Terms") govern your access to and use of the website, mobile application (“Mobile App”), and other digital services (collectively, the "Service") provided by the Bar Association of the Kingdom of Cambodia ("BAKC", "we", "us", or "our").
1.2 By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Service.
2. Key Terms
For the purposes of these Terms:
- Word “You” refer to account holder who registered to use the BACK website and mobile application.
- Account means a registered user account created to access certain features of the Service.
- Content means all information, text, images, documents, publications, notices, videos, software, databases, and other materials available through the Service.
- Member means a lawyer, trainee lawyer, law firm representative, or other person officially registered with the Bar Association of the Kingdom of Cambodia.
- Service means the BAKC website, mobile application, and all related digital platforms.
- User means any individual or legal entity accessing or using the Service.
- PIN means a 4-digits Personal Identification Number (Numeric) that is determined directly by you when you register for using BAKC Mobile App.
- OTP is a One Time Password and it has 6-digit number code that is automatically generated by the system and send to your Mobile Phone Number or email to approve the registration for using BAKC Mobile App or authorize any financial transactions which perform via BAKC Mobile App. This OTP code is valid for one time use only or one transaction.
3. Acceptance of Terms
3.1 By using the Service, you agree to comply with these Terms, our Privacy Policy, and all applicable laws and regulations of the Kingdom of Cambodia.
3.2 If you use the Service on behalf of an organization or law firm, you represent that you have the authority to bind that organization to these Terms.
4. Eligibility
4.1 You may use the Service only if:
- you have the legal capacity to enter into binding agreements;
- the information you provide is accurate and complete;
- you comply with applicable Cambodian laws and these Terms.
4.2 Certain features are available only to registered Members or authorized users.
5. User Accounts
5.1 To access certain services, you may be required to register an Account.
5.2 You agree to:
- provide accurate and complete information;
- keep your account information up to date;
- maintain the confidentiality of your login credentials;
- immediately notify BAKC of any unauthorized use of your Account.
5.3 You are responsible for all activities conducted under your Account.
5.4 BAKC reserves the right to suspend or terminate any Account that violates these Terms or compromises the security of the Service.
6. Use of the Service
6.1 You agree to use the Service only for lawful purposes.
6.2 You shall not:
- use the Service in violation of any applicable law or regulation;
- attempt to gain unauthorized access to any part of the Service;
- interfere with the operation or security of the Service;
- upload malicious software, viruses, or harmful code;
- impersonate another person or entity;
- submit false, misleading, or fraudulent information;
- misuse the lawyer directory, membership database, or other information available through the Service.
7. Member Information
7.1 The Service may display certain information relating to registered lawyers and law firms.
7.2 Publicly available information is provided for informational purposes only.
7.3 Members are responsible for ensuring that the information associated with their profiles is accurate and up to date.
7.4 BAKC reserves the right to verify, update, modify, or remove inaccurate information where appropriate.
8. Intellectual Property
8.1 Unless otherwise stated, all Content available through the Service is owned by or licensed to BAKC and is protected by applicable intellectual property laws.
8.2 You may view, download, or print materials solely for personal, educational, or non-commercial use.
8.3 You may not:
- reproduce;
- distribute;
- modify;
- publish;
- sell;
- license; or
- commercially exploit
any Content without prior written permission from BAKC.
9. Third-Party Services
9.1 The Service may contain links to third-party websites, platforms, or services.
9.2 BAKC does not control or endorse these third-party services and is not responsible for their content, availability, privacy practices, or security.
9.3 Your use of third-party services is at your own risk.
10. Availability of the Service
10.1 BAKC strives to keep the Service available and functioning properly.
10.2 However, we do not guarantee that the Service will:
- always be available;
- operate without interruption;
- be free from errors;
- be free from viruses or other harmful components.
10.3 We may suspend or restrict access for maintenance, upgrades, security reasons, or operational requirements without prior notice.
11. Disclaimer
11.1 The information provided through the Service is intended for general informational and administrative purposes only.
11.2 Nothing contained in the Service constitutes legal advice or creates a lawyer-client relationship.
11.3 While BAKC makes reasonable efforts to ensure the accuracy of the information published, we make no warranties regarding its completeness, reliability, or accuracy.
11.4 Users should independently verify information before relying upon it.
12. Limitation of Liability
12.1 To the fullest extent permitted by applicable law, BAKC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or relating to:
- your use of the Service;
- inability to access the Service;
- errors or omissions in the Content;
- unauthorized access to your Account;
- interruptions, delays, or technical failures.
13. Privacy
13.1 Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal information.
13.2 By using the Service, you consent to the practices described in the Privacy Policy.
14. Suspension and Termination
14.1 BAKC may suspend, restrict, or terminate access to the Service at any time if:
- you violate these Terms;
- your use threatens the security or integrity of the Service;
- required by law; or
- necessary to protect BAKC, its members, or the public.
14.2 Termination does not affect any rights or obligations that arose before termination.
15. Electronic Communications
15.1 By using the Service or creating an Account, you consent to receive communications from BAKC electronically, including by email, SMS, mobile application notifications, or other electronic means where applicable.
15.2 These communications may include:
- account-related notifications;
- membership updates;
- event registrations and confirmations;
- training and continuing legal education announcements;
- administrative notices;
- security alerts; and
- updates relating to the Service.
15.3 You acknowledge that electronic communications satisfy any legal requirement that such communications be in writing.
16. Member Conduct
16.1 Members using the Service shall conduct themselves professionally and in accordance with:
- the laws of the Kingdom of Cambodia;
- the Statute of Lawyers and applicable regulations;
- the internal rules and regulations of BAKC; and
- the applicable Code of Ethics and Professional Conduct governing lawyers.
16.2 Members shall not use the Service in any manner that:
- damages the reputation of BAKC;
- infringes the rights of other users;
- disrupts the operation or security of the Service; or
- involves fraudulent, misleading, or unlawful activities.
16.3 BAKC reserves the right to suspend or restrict access to any Member Account where misuse of the Service is identified, without prejudice to any disciplinary proceedings or legal actions that may be taken under applicable laws or BAKC regulations.
17. Electronic Submission of Documents
17.1 The Service may permit users or Members to submit applications, forms, supporting documents, requests, or other materials electronically.
17.2 Submission of documents through the Service does not automatically constitute:
- acceptance of the submission;
- approval of an application;
- recognition of legal rights or status; or
- confirmation that statutory or regulatory requirements have been satisfied.
17.3 BAKC reserves the right to request additional information, reject incomplete submissions, or require original documents where necessary.
17.4 Users remain responsible for ensuring that all submitted information is accurate, complete, and truthful.
18. Online Payments
18.1 Where the Service provides facilities for payment of membership fees, event registration fees, training fees, or other charges, users agree that:
- all payments shall be made using approved payment methods;
- payment obligations remain subject to applicable BAKC regulations;
- payment confirmation does not necessarily constitute approval of any application or registration unless expressly stated by BAKC.
18.2 Unless otherwise specified, payments made through the Service are non-refundable except where required by applicable law or expressly approved by BAKC.
19. Force Majeure
19.1 BAKC shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control.
19.2 Such circumstances may include, but are not limited to:
- natural disasters;
- floods;
- fires;
- epidemics or pandemics;
- acts of government;
- war or civil unrest;
- labor disputes;
- power outages;
- failures of telecommunications or internet services; or
- cyberattacks or other security incidents.
19.3 During such events, BAKC may temporarily suspend or limit access to the Service without liability.
20. Severability
20.1 If any provision of these Terms is determined by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
21. Entire Agreement
21.1 These Terms, together with the Privacy Policy and any additional policies or guidelines published by BAKC in relation to the Service, constitute the entire agreement between you and BAKC regarding your use of the Service and supersede any prior understandings or agreements relating to the same subject matter.
22. Governing Law
22.1 These Terms shall be governed by and interpreted in accordance with the laws of the Kingdom of Cambodia.
22.2 Any dispute arising from these Terms or the use of the Service shall be subject to the jurisdiction of the competent courts of the Kingdom of Cambodia.
23. Changes to These Terms
23.1 BAKC may revise these Terms from time to time.
23.2 Updated versions will be published on the website and/or mobile application together with the revised "Last Updated" date.
23.3 Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
24. Language
24.1 These Terms are made in Khmer and English. In case there is any conflict or inconsistency between the two versions, Khmer language shall prevail.
