កិច្ចពិភាក្សាស្តីពី «កិច្ចសន្យាខ្ចីប្រាក់»

នាថ្ងៃពុធ ១០រោច ខែជេស្ឋ ឆ្នាំមមី អដ្ឋស័ក ព.ស.២៥៧០ ត្រូវនឹងថ្ងៃទី១០ ខែមិថុនា ឆ្នាំ២០២៦ លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់លោកមេធាវី យ័ន ស៊ីណាល់ សមាជិកក្រុមប្រឹក្សាគណៈមេធាវី ថ្លែងសុន្ទរកថាបើកកិច្ចពិភាក្សាស្តីពី «កិច្ចសន្យាខ្ចីប្រាក់» ដែលសហការរៀបចំរវាងគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពូជា និងវិភាគទានច្បាប់ ដោយមានអ្នកសម្របសម្រួលគឺ លោកស្រីមេធាវី ទេព បូផល ស្ថាបនិកវិភាគទានច្បាប់ លោក អេង សុភា ប្រធាននាយកដ្ឋានសេវាធនាគារនៃធនាគារជាតិនៃកម្ពុជា លោកមេធាវី អ៊ីវ ប៉ូលី កញ្ញាមេធាវី ឈុំ មុនីសុជាតា និងលោកមេធាវី សោម រតនា អ្នកបណ្តុះបណ្តាលនៃវិភាគទានច្បាប់ និងមានការចូលរួមពីថ្នាក់ដឹកនាំអគ្គលេខាធិការដ្ឋានគណៈមេធាវី ថ្នាក់ដឹកនាំមជ្ឈមណ្ឌលបណ្តុះបណ្តាលវិជ្ជាជីវៈមេធាវី ព្រមទាំងសិក្ខាកាមចូលរួមដោយផ្ទាល់សរុបចំនួន ៣៥២នាក់។ ជាកិច្ចចាប់ផ្តើម លោកស្រី មេធាវី ទេព បូផល ស្ថាបនិកវិភាគទានច្បាប់ បានលើកឡើងពីកិច្ចសហការរវាងគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា និងវិភាគទានច្បាប់ ក្នុងគម្រោងអនុស្សរណៈនៃការយោគយល់លើកទី១ លើកទី២ និងលើកទី៣ ដែលពាក់ព័ន្ធនឹងការបណ្ដុះបណ្ដាលច្បាប់ជូនដល់សមាជិកគណៈមេធាវី។ តាមរយៈកិច្ចសហការនេះ កិច្ចពិភាក្សាស្ដីពី កិច្ចសន្យាខ្ចីប្រាក់​ បានរៀបចំឡើងក្នុងគោលបំណងបង្ហាញឱ្យសិក្ខាកាមបានស្វែងយល់អំពីយន្តការផ្លូវច្បាប់ពាក់ព័ន្ធនឹងការប្រាក់​ ប្រាក់សំណងនៃការខូចខាតដោយសារការយឺតយ៉ាវក្នុងការអនុវត្តកាតព្វកិច្ច ការផ្សព្វផ្សាយរូបភាពរបស់កូនបំណុលជាសាធារណៈ បញ្ហាពាក់ព័ន្ធនឹងមូលប្បទានបត្រ(សែក) ការធានា បំណុល និងនីតិវិធីទាមទារសិទ្ធិតាមផ្លូវតុលាការ។ ថ្លែងក្នុងឱកាសនោះ លោកមេធាវី យ័ន ស៊ីណាល់ បានលើកឡើងនូវគោលនយោបាយ៩ចំណុច ក្នុងនោះគោលនយោបាយទី១ របស់លោកប្រធាន គឺ «ចូលរួមជាមួយរាជរដ្ឋាភិបាល និងតួអង្គពាក់ព័ន្ធ ដើម្បីលើកកម្ពស់យុត្តិធម៌សង្គម និងពង្រឹងប្រសិទ្ធភាពនៃការអនុវត្តច្បាប់» ដែលគោលនយោបាយនេះស្របនឹងទិសដៅផ្សព្វផ្សាយច្បាប់របស់វិភាគទានច្បាប់។ លោកមេធាវី ក៏បានបន្ថែមថា វិភាគទានច្បាប់ ជាស្ថាប័នចែករំលែកច្បាប់ផ្នែករដ្ឋប្បវេណីដល់មិត្តនិស្សិតក៏ដូចជាសាធារណជនទូទៅដោយមិនស្វែងរកចំណេញ ហើយជាដៃគូសហការដ៏សកម្មរបស់គណៈមេធាវី​ក្នុងការបណ្តុះបណ្តាលច្បាប់ពាក់ព័ន្ធនឹងវិស័យរដ្ឋប្បវេណីដល់បងប្អូនសហភាតា។ តាមរយៈអនុស្សរណៈនៃការយោគយល់គ្នាកន្លងមក គណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា និងវិភាគទានច្បាប់ បានសហការរៀបចំសិក្ខាសាលាលើប្រធានបទជាច្រើនពាក់ព័ន្ធនឹងវិស័យរដ្ឋប្បវេណី ជាពិសេសនីតិវិធីរដ្ឋប្បវេណី ដែលសុទ្ធសឹងជាប្រធានបទល្អៗ និងមានសារៈសំខាន់ក្នុងការអនុវត្តវិជ្ជាជីវៈមេធាវីរបស់បងប្អូនសហភាតា។ បន្ទាប់ពីកិច្ចពិភាក្សាបានដំណើរការអស់រយៈពេលពេញមួយថ្ងៃ លោកមេធាវី យ័ន ស៊ីណាល់ សមាជិកក្រុមប្រឹក្សាគណៈមេធាវី តំណាងដ៏ខ្ពង់ខ្ពស់លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានអញ្ជើញថ្លែងសុន្ទរកថាបិទសិក្ខាសាលា។ លោកមេធាវីជឿជាក់ថា បងប្អូនសហភាតានឹងយល់ច្បាស់ពីយន្តការផ្លូវច្បាប់ទាក់ទងនឹង​ «កិច្ចសន្យាខ្ចីប្រាក់» និងមានក្តីសង្ឃឹមថា ការបណ្តុះបណ្តាលរួមគ្នារវាងគណៈមេធាវី និងវិភាគទានច្បាប់នឹងផ្តល់ជាផ្លែផ្កាដល់បងប្អូនសហភាតាក្នុងការអនុវត្តវិជ្ជាជីវៈឱ្យបានសមស្របតាមច្បាប់ សំដៅទទួលបានទំនុកចិត្តពីកូនក្តី និងទស្សនៈជាវិជ្ជមានពីសាធារណជនចំពោះវិជ្ជាជីវៈមេធាវី​ ក្នុង​គោល​ដៅ​រួមគ្នាដើម្បីវិបុលភាពនៃវិជ្ជាជីវៈមេធាវី។

Discussion Panel on “Loan Agreements”

On Wednesday, 10th June, 2026, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia, assigned Attorney YORN Sinal, Member of the Bar Council, to deliver the opening remarks at the discussion panel on “Loan Agreements,” jointly organized by the Bar Association of the Kingdom of Cambodia and Contribution of Law. The session was moderated by Attorney TEP Bophal, Founder of Contribution of Law; Mr. ENG Sophea, Director of the Banking Services Department of the National Bank of Cambodia; Attorney IV Poly; Attorney CHHUM Monysocheata; and Attorney SOM Ratana, lecturers of Contribution of law. The event was attended by the leaders of the Secretariat General of the Bar Association, the leaders of the Lawyer Training Center, and a total of 352 participants attending in person. At the outset, Attorney TEP Bophal, Founder of Contribution of Law, highlighted the longstanding cooperation between the Bar Association of the Kingdom of Cambodia and Contribution of Law through the first, second, and third Memoranda of Understanding concerning legal education and training for members of the Bar. Through this collaboration, the discussion panel on “Loan Agreements” was organized to enhance participants’ understanding of the legal mechanisms relating to interest, damages arising from delay in the performance of obligations, the public dissemination of debtors’ photographs, issues relating to negotiable instruments (cheques), debt guarantees, and judicial procedures for the enforcement of rights. In his remarks, Attorney YORN Sinal referred to the President’s nine-point policy agenda, particularly the first policy, namely “to cooperate with the Royal Government and relevant stakeholders in promoting social justice and strengthening the effectiveness of law enforcement.” He noted that this policy is in line with the mission of Contribution of Law in promoting legal knowledge. He further emphasized that Contribution of Law is a non-profit institution dedicated to sharing knowledge in the field of civil law with students and the general public and has been an active partner of the Bar Association in providing legal training in civil law to fellow lawyers. Through the Memoranda of Understanding concluded over the years, the Bar Association and Contribution of Law have jointly organized numerous seminars on civil law topics, particularly civil procedure, all of which have been highly relevant and beneficial to the practice of the legal profession. Following a full day of discussions, Attorney YORN Sinal, Member of the Bar Council and representative of Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia, delivered the closing remarks. He expressed his confidence that fellow lawyers had gained a deeper understanding of the legal mechanisms relating to “Loan Agreements” and expressed his hope that the continued collaboration between the Bar Association and Contribution of Law would bear fruitful results for the legal profession, enabling lawyers to practice in accordance with the law, earn the trust of their clients, and promote a positive public perception of the legal profession, all in pursuit of the common goal of “Together for the Prosperity of the Legal Profession.”
