លទ្ធផលនៃដំណើរទស្សនកិច្ចសិក្សារបស់ក្រុមការងារបច្ចេកទេសនៃគម្រោងអភិវឌ្ឍន៍វិស័យច្បាប់ និងយុត្តិធម៌ ជំហានទី៦

នាល្ងាច ថ្ងៃសៅរ៍ ១១កើត ខែទុតិយាសាឍ ឆ្នាំមមី អដ្ឋស័ក ព.ស.២៥៧០ ត្រូវនឹងថ្ងៃទី២៥ ខែកក្កដា ឆ្នាំ២០២៦ លោកមេធាវី អ៊ីវ ប៉ូលី សមាជិកក្រុមការងារបច្ចេកទេសនៃគម្រោងអភិវឌ្ឍន៍វិស័យច្បាប់ និងយុត្តិធម៌ ជំហានទី៦ តំណាងឱ្យគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានបញ្ចប់ដំណើរទស្សនកិច្ចសិក្សារបស់ក្រុមការងារបច្ចេកទេសនៃគម្រោងអភិវឌ្ឍន៍វិស័យច្បាប់ និងយុត្តិធម៌ ជំហានទី៦ ដែលដឹកនាំដោយឯកឧត្តម តាន់ហ៊ាង ដាវ័ណ្ណ រដ្ឋលេខាធិការក្រសួងយុត្តិធម៌។ នៅក្នុងដំណើរទស្សនកិច្ចសិក្សារយៈពេល ២សប្តាហ៍ នេះ ក្រុមការងារបច្ចេកទេសនៃគម្រោងអភិវឌ្ឍន៍វិស័យច្បាប់ និងយុត្តិធម៌ ជំហានទី៦ បានចូលរួមកម្មវិធីសំខាន់ ៗ និងចម្បងៗ រួមមាន៖

១. ការធ្វើបទឧទ្ទេសនាមដោយសាស្ត្រាចារ្យជប៉ុន លើករណីសិក្សា ដោយផ្តោតលើការសរសេរអង្គហេតុចម្បងអំពីសិទ្ធិលុបចោលនូវអំពើដែលនាំឱ្យខូចប្រយោជន៍ សិទ្ធិទាមទារសំណងការខូចខាតដោយផ្អែកលើអំពើអនីត្យានុកូល សិទ្ធិទាមទារឱ្យប្រគល់ដីដោយផ្អែកលើកម្មសិទ្ធិ បណ្តឹងទាមទារឱ្យសងប្រាក់កម្ចី និងបណ្តឹងបញ្ជាក់អំពីអត្ថិភាពនៃហ៊ីប៉ូតែក។

២.បទឧទ្ទេសនាមលើប្រធានបទមួយចំនួនទៀតដូចជា សាលក្រមកំបាំងមុខ និងបណ្តឹងទាស់ ការតាក់តែងសាលក្រមរដ្ឋប្បវេណី-ការអះអាងរបស់ភាគី និងការវិនិច្ឆ័យចំពោះចំណុចវិវាទ។

៣. ការធ្វើទស្សនកិច្ចនៅសាលាដំបូងតូក្យូ (មជ្ឈមណ្ឌលអនុវត្តរឿងក្តីរដ្ឋប្បវេណី)

៤. ការធ្វើបទបង្ហាញអំពីការយល់ឃើញរបស់ភាគីកម្ពុជាលើករណីសិក្សា

៥.ការសរសេរសៀវភៅមេរៀនគោលអំពីករណីសិក្សាទាំងនេះ ដើម្បីផ្សព្វផ្សាយបន្តជូនអ្នកច្បាប់កម្ពុជា ជាអាទិ៍។

Outcomes of the Study Visit of the Technical Working Group the Legal and Judicial Development Project - Phase VI

On the evening of Saturday, 25th July 2026, Attorney IV Poly, a member of the Technical Working Group of the Legal and Judicial Sector Development Project - Phase VI, representing the Bar Association of the Kingdom of Cambodia, concluded the study visit of the Technical Working Group. The delegation was led by H.E. TANHEANG Davann, Secretary of State of the Ministry of Justice. During the two-week study visit, the Technical Working Group participated in a number of key activities, including:

1. Lectures delivered by Japanese professors on case studies, focusing on drafting the principal issues relating to: the right to revoke acts detrimental to creditors, claims for damages arising from unlawful acts (torts), claims for the return of land based on ownership rights, claims for repayment of loans, and actions seeking confirmation of the existence of a mortgage.

2. Lectures on additional topics, including: default judgments and objections to default judgments, and drafting civil judgments, particularly the parties' pleadings and judicial determination of disputed issues.

3. A study visit to the Tokyo District Court (Civil Case Practice Center).

4. Presentations by the Cambodian delegation on their analysis and perspectives regarding the case studies.

5. The drafting of a core training manual based on these case studies for future dissemination to members of Cambodia's legal profession.
