សិក្ខាសាលាពិគ្រោះយោបល់លើ «សេចក្តីព្រាងច្បាប់ស្តីពីលក្ខន្តិកៈសារការី» (លើកទី២)

នាព្រឹក ថ្ងៃព្រហស្បតិ៍ ៨រោច ខែទុតិយាសាឍ ឆ្នាំមមី អដ្ឋស័ក ព.ស.២៥៧០ ត្រូវនឹងថ្ងៃទី៦ ខែសីហា ឆ្នាំ២០២៦ លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់ក្រុមការងារគណៈមេធាវីចូលរួមសិក្ខាសាលាពិគ្រោះយោបល់លើ «សេចក្តីព្រាងច្បាប់ស្តីពីលក្ខន្តិកៈសារការី» ដែលរៀបចំដោយក្រសួងយុត្តិធម៌ នៅសាលមរតកតេជោនៃបណ្ឌិត្យសភាភូមិន្ទយុត្តិធម៌កម្ពុជា និងមានការអញ្ជើញចូលរួមសុន្ទរកថាបើក និង​បិទសិក្ខាសាលាដោយ ឯកឧត្តម តាន់ហ៊ាង ដាវ័ណ្ណ រដ្ឋលេខាធិការក្រសួងយុត្តិធម៌ និងជាតំណាងដ៏ខ្ពង់ខ្ពស់ ឯកឧត្តម កើត រិទ្ធ ឧបនាយករដ្ឋមន្ត្រី រដ្ឋមន្ត្រីក្រសួងយុត្តិធម៌។ ការចូលរួមសិក្ខាសាលានាឱកាសនេះ ជាលើកទី២ ដែលគណៈមេធាវីដែលបានរួមចំណែកក្នុងការផ្តល់យោបល់លើសេចក្តីព្រាងច្បាប់ស្តីពីលក្ខន្តិកៈសារការី។ សិក្ខាសាលានេះ រៀបចំឡើងក្នុងគោលបំណងដើម្បីប្រមូលមតិយោបល់ និងធាតុចូលសំខាន់ៗបន្ថែមពីតួអង្គពាក់ព័ន្ធ សំដៅធ្វើឱ្យសេចក្តីព្រាងច្បាប់នេះ កាន់តែមានភាពគ្រប់ជ្រុងជ្រោយ ប្រកបដោយបរិយាប័ន្ន និងប្រាកដនិយម ពោលគឺការរៀបចំច្បាប់ដែលអាចអនុវត្តបានហើយការរៀបចំលើកទី២នេះ សំដៅប្រមូលធាតុចូលពីតួអង្គពាក់ព័ន្ធនឹងការអនុវត្តវិជ្ជាជីវៈសារការី រួមមានមេធាវី អាជ្ញាសាលា ក៏ដូចជាសារការីខ្លួនឯងផ្ទាល់ ដែលសុទ្ធសឹងជាអ្នកអនុវត្តការងារជាក់ស្តែង ក្នុងគោលដៅស្វែងយល់ពីបញ្ហាដែលកើតឡើងនៅក្នុងការអនុវត្ត ក៏ដូចជាស្វែងរកដំណោះស្រាយរួមមួយ។ ដើម្បីសម្រេចបានគោលបំណងនេះ សិក្ខាសាលាត្រូវបានរៀបចំឱ្យមានការធ្វើបទបង្ហាញដូចខាងក្រោម៖

១​. របាយការណ៍ស្តីពី «វឌ្ឍនភាពការងាររៀបចំសេចក្តីព្រាងច្បាប់ស្តីពីលក្ខន្តិកៈសារការី» ដោយ ឯកឧត្តម យ៉ម ផារ៉ូត ប្រតិភូរាជរដ្ឋាភិបាល និងជាអគ្គនាយកនៃអគ្គនាយកដ្ឋានកិច្ចការរដ្ឋប្បវេណីនៃក្រសួងយុត្តិធម៌

២. បទបង្ហាញស្តីពី «សារការី» ដោយ លោក កាន់ សុទ្ធប៉ូលីន ប្រធាននាយកដ្ឋានសារការីនៃក្រសួងយុត្តិធម៌

៣. បទបង្ហាញស្តីពី «មន្ទីរសារការី» ដោយ លោកជំទាវ អ៊ឹង រីណា អនុរដ្ឋលេខាធិការនៃក្រសួងយុត្តិធម៌

៤. បទបង្ហាញស្តីពី «ការគ្រប់គ្រងវិជ្ជាជីវៈសារការី» ដោយ ឯកឧត្តម យ៉ម ផារ៉ូត ប្រតិភូរាជរដ្ឋាភិបាល និងជាអគ្គនាយកនៃអគ្គនាយកដ្ឋានកិច្ចការរដ្ឋប្បវេណីនៃក្រសួងយុត្តិធម៌

៥. កិច្ចពិភាក្សា និងមតិបូកសរុប ដឹកនាំដោយ ឯកឧត្តម តាន់ហ៊ាង ដាវ័ណ្ណ រដ្ឋលេខាធិការក្រសួងយុត្តិធម៌ និងជាតំណាងដ៏ខ្ពង់ខ្ពស់ ឯកឧត្តម កើត រិទ្ធ ឧបនាយករដ្ឋមន្ត្រី រដ្ឋមន្ត្រីក្រសួងយុត្តិធម៌ នៅក្នុងវេទិកាពិភាក្សានេះ ក្រុមការងារគណៈមេធាវីក៏បានលើកជាយោបល់មួយចំនួនពាក់ព័ន្ធនឹងខ្លឹមសារនៃបទប្បញ្ញត្តិមួយចំនួន ក៏ដូចជាទំនាក់ទំនងរវាងការអនុវត្តវិជ្ជាជីវៈមេធាវី និងវិជ្ជាជីវៈសារការីផងដែរ។

Consultative Workshop on the Draft Law on the Statute of Notaries (Second Session)

On the morning of Thursday, 6th August 2026, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia (BAKC), designated a BAKC delegation to participate in the Second Consultative Workshop on the Draft Law on the Statute of Notaries, organized by the Ministry of Justice at the Techo Heritage Hall of the Royal Academy of Justice of Cambodia. The opening and closing remarks were delivered by H.E. TANHEANG Davann, Secretary of State of the Ministry of Justice and the High Representative of H.E. KOEUT Rith, Deputy Prime Minister and Minister of Justice. This marked the second consultative workshop in which the Bar Association participated by providing comments and recommendations on the Draft Law on the Statute of Notaries. The workshop was organized to gather additional comments and practical input from relevant stakeholders in order to make the draft law more comprehensive, inclusive, and practical. The second round of consultations specifically sought feedback from professionals directly involved in the practice of the notarial profession, including attorneys, bailiffs, and notaries themselves, with the objective of identifying challenges encountered in practice and developing practical solutions. To achieve these objectives, the workshop featured the following presentations:

1. Progress Report on the Draft Law on the Statute of Notaries, Presented by H.E. YOM Pharot, Delegate of the Royal Government and Director General of the General Department of Civil Affairs, Ministry of Justice.

2. Presentation on “Notaries presented by Mr. KAN Sothpolin, Director of the Department of Notaries, Ministry of Justice.

3.Presentation on “Notarial Offices”presented by H.E. ING Rina, Under Secretary of State of the Ministry of Justice.

4. Presentation on “Regulation of the Notarial Profession” presented by H.E. YOM Pharot, Delegate of the Royal Government and Director General of the General Department of Civil Affairs, Ministry of Justice.

5. Panel Discussion and Closing Remarks moderated by H.E. TANHEANG Davann, Secretary of State of the Ministry of Justice and the High Representative of H.E. KOEUT Rith, Deputy Prime Minister and Minister of Justice. During the discussion session, the BAKC delegation also provided comments on several provisions of the draft law, as well as on matters relating to the relationship between the practice of the lawyer profession and the notarial profession.
