កិច្ចប្រជុំពិភាក្សាអំពីការត្រៀមរៀបចំសិក្ខាសាលាសិក្សាស្វែងយល់ ពិគ្រោះ និងផ្តល់យោបល់លើសេចក្តីព្រាងច្បាប់ភូមិបាល (ថ្មី) (លើកទី២)

នាព្រឹក ថ្ងៃព្រហស្បតិ៍ ៨កើត ខែចេត្រ ឆ្នាំម្សាញ់ សប្តស័ក ព.ស.២៥៦៩ ត្រូវនឹងថ្ងៃទី២៦ ខែមីនា ឆ្នាំ២០២៦ ក្រុមការងារចំពោះកិច្ចទទួលបន្ទុកអនុវត្តអនុស្សរណៈនៃការយោគយល់រវាងក្រសួង ដ.ន.ស. និងគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា ដឹកនាំដោយលោកមេធាវី អ៉ីវ ប៉ូលី ចូលរួមកិច្ចប្រជុំពិភាក្សាជាមួយតំណាងក្រសួង ដ.ន.ស. ទៅលើប្រធានបទទី១ «ការចុះបញ្ជីអំពីកម្មសិទ្ធិ-ករណីទ្រព្យសម្បត្តិរួមប្ដីប្រពន្ធ» ក្រោមអធិបតីភាព ឯកឧត្តម ថេង ច័ន្ទសង្វារ រដ្ឋលេខាធិការក្រសួង ដ.ន.ស. ក្នុងគោលបំណងបង្ហាញអំពីចំណុចដែលនឹងត្រូវលើកយកមកពិភាក្សានៅក្នុងប្រធានបទ និងស្នើសុំមតិយោបល់ពីតំណាងក្រសួង ដ.ន.ស.។ ជាកិច្ចចាប់ផ្តើម លោកស្រីមេធាវី ទេព បូផល សមាជិកក្រុមការងារចំពោះកិច្ច បានធ្វើបទបង្ហាញខ្លីអំពីបញ្ហាផ្សេងៗពាក់ព័ន្ធនឹងចុះបញ្ជីទ្រព្យសម្បត្តិរួមប្តីប្រពន្ធ បន្ទាប់មកបានលើកយកនូវចំណុចមួយចំនួនមកធ្វើការពិភាក្សា មានជាអាទិ៍៖

១. លក្ខខណ្ឌតតាំង៖ លក្ខខណ្ឌតតាំងនៃកិច្ចសន្យាទ្រព្យសម្បត្តិផ្អែកតាមក្រមរដ្ឋប្បវេណី និងលក្ខខណ្ឌតតាំងនៃការចុះបញ្ជីដីធ្លីផ្អែកតាមច្បាប់ភូមិបាល (ថ្មី)

២. ការសន្មតអំពីចំណែកនៃទ្រព្យសម្បត្តិរួមប្តីប្រពន្ធ៖ ករណីមរណភាព និងករណីរំលាយទំនាក់ទំនអាពាហ៍ពិពាហ៍ ជាអាទិ៍

៣. ខ្លឹមសារនៃលេខាចារឹកចំពោះការចុះបញ្ជីអំពីទ្រព្យសម្បត្តិរួមប្តីប្រពន្ធ បន្ទាប់ពីបានបញ្ចប់កិច្ចពិភាក្សា ក្រុមការងារនៃស្ថាប័នទាំងពីរ បានឯកភាពគ្នាក្នុងការកែសម្រួលចំណុចមួយចំនួន និងកំណត់កាលបរិច្ឆេទសម្រាប់កិច្ចប្រជុំបន្ទាប់។

Discussion on Preparations for the Seminar on Reviewing and Consulting on Land Law Draft (New) ​(2nd Meeting)

On the morning of Thursday, 26th March 2026, the working group responsible for implementing the MOU between the Ministry of Land Management, Urban Planning and Construction and the Bar Association of the Kingdom of Cambodia, led by Attorney IV Poly, held a discussion meeting with representatives of the Ministry on Topic 1: “Registration of Ownership – Cases of Common Property.” The meeting was presided over by H.E. THENG Chan Sangvar, Secretary of State of the Ministry of Land Management, Urban Planning and Construction, with the objective of presenting the key issues to be discussed under the topic and seeking comments from the Ministry’s representatives. At the beginning of the meeting, Attorney TEP Bophal, member of the working group, delivered a brief presentation on issues related to the registration of common property. She then raised several points for discussion, including:

1. Opposing Conditions: the opposing conditions of property agreements under the Civil Code and the opposing conditions of land registration under the new Land Law.

2. Presumption of shares in common property: including cases of death and annulment of marriage.

3. The content of annotations relating to the registration of common property. After the discussion, the working groups of both institutions agreed to revise several points and set a date for the next meeting.
