សិក្ខាសាលា «សិក្សាស្វែងយល់ ពិគ្រោះ និងផ្ដល់យោបល់លើសេចក្ដីព្រាងច្បាប់ភូមិបាល (ថ្មី)»

នាព្រឹកថ្ងៃអង្គារ ១២កើត ខែពិសាខ ឆ្នាំមមី អដ្ឋស័ក ព.ស.២៥៦៩ ត្រូវនឹងថ្ងៃទី២៨ ខែមេសា ឆ្នាំ២០២៦ លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់ លោកមេធាវី អ៊ីវ ប៉ូលី សមាជិកក្រុមប្រឹក្សាគណៈមេធាវី ចូលរួមថ្លែងមតិចំណាប់អារម្មណ៍ក្នុងពិធីបើកសិក្ខាសាលា «សិក្សាស្វែងយល់ ពិគ្រោះ និងផ្ដល់យោបល់លើសេចក្ដីព្រាងច្បាប់ភូមិបាល (ថ្មី)» ក្រោមអធិបតីភាពដ៏ខ្ពង់ខ្ពស់ ឯកឧត្តម សាយ សំអាល់ ឧបនាយករដ្ឋមន្ត្រី រដ្ឋមន្ត្រីក្រសួងរៀបចំដែនដី នគរូបនីយកម្ម និងសំណង់ (ដ.ន.ស.) ដោយមានវត្តមានថ្នាក់ដឹកនាំក្រសួង ដ.ន.ស. និងគណៈមេធាវី ព្រមទាំងសមាជិកគណៈមេធាវី ចូលរួមប្រមាណជា ៤៦០នាក់។ ថ្លែងក្នុងឱកាសនោះ លោកមេធាវី អ៊ីវ ប៉ូលី បានលើកឡើងអំពីអនុស្សរណៈនៃការយោគយល់គ្នារវាងក្រសួងរៀបចំដែនដី នគរូបនីយកម្ម និងសំណង់ និងគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា ចុះថ្ងៃទី៤ ខែមេសា ឆ្នាំ២០២៥ ដែលបានបង្កើតឱ្យមានក្រុមការងារចំពោះកិច្ចរបស់គណៈមេធាវីដើម្បីផ្ដល់យោបល់លើសេចក្ដីព្រាងច្បាប់ភូមិបាល (ថ្មី)។ តាមរយៈគម្រោងអនុស្សរណៈនេះ ក្រុមការងារបានបញ្ចប់ផ្ដល់យោបល់ទៅលើផ្នែកមួយចំនួននៃសេចក្ដីព្រាងច្បាប់នេះ ហើយកត់សម្គាល់នូវចំណុចស្មុគស្មាញមួយចំនួនដែលគួរតែមានការពិភាក្សាឱ្យបានច្បាស់លាស់ និងបានកំណត់ជាប្រធានបទពិភាក្សាសម្រាប់សិក្ខាសាលានាថ្ងៃនេះ។ នៅក្នុងសុន្ទរកថាបើកកម្មវិធី ឯកឧត្តមឧបនាយករដ្ឋមន្ត្រី បានលើកឡើងអំពីសារៈសំខាន់នៃការរៀបចំច្បាប់ភូមិបាលឡើងវិញ ដើម្បីឱ្យស្របនឹងការវិវត្តរបស់សង្គម ពោលគឺត្រូវថ្លឹងថ្លែងពីទិដ្ឋភាពនយោបាយ សង្គម និងសេដ្ឋកិច្ច ហើយច្បាប់ថ្មីនេះត្រូវមានគុណតម្លៃគ្រប់គ្រាន់ អាចអនុវត្តបានស្របតាមបរិបទសង្គមខ្មែរ។ ឯកឧត្តមឧបនាយករដ្ឋមន្ត្រីបានបន្តថា សេចក្ដីព្រាងច្បាប់ថ្មីនេះ ជាការធ្វើបច្ចុប្បន្នភាពច្បាប់ ដោយយកបទពិសោធ បញ្ហានៃការអនុវត្តកន្លងមក មកធ្វើជាធាតុចូល ពិសេសគឺការប្រមូលនូវបទប្បញ្ញត្តិក្រោមច្បាប់នានាដែលបានដាក់ចេញកន្លងមក យកមកកែសម្រួលឡើងវិញ ហើយបញ្ចូលទៅក្នុងសេចក្ដីព្រាងច្បាប់ថ្មី ដើម្បីឱ្យការអនុវត្តច្បាប់ក្នុងវិស័យដីធ្លីនាពេលអនាគតកាន់តែមានសង្គតិភាព និងប្រសិទ្ធភាព។ គួរបញ្ជាក់ថាសិក្ខាសាលានេះ មានការធ្វើបទបង្ហាញអំពីសេចក្តីព្រាងច្បាប់ភូមិបាល (ថ្មី) ដោយឯកឧត្តម ថេង ច័ន្ទសង្វារ រដ្ឋលេខាធិការក្រសួង ដ.ន.ស. និងបទបង្ហាញលើប្រធានបទពិភាក្សាចំនួន ៣គឺ

ប្រធានបទទី១ «ការចុះបញ្ជីអំពីកម្មសិទ្ធិ-ករណីទ្រព្យសម្បត្តិរួមប្តីប្រពន្ធ» សម្របសម្រួលដោយលោកស្រីមេធាវី ទេព បូផល

ប្រធានបទទី២ «ការចុះបញ្ជីអចលនវត្ថុផ្អែកតាមសេចក្តីសម្រេចរបស់តុលាការ» សម្របសម្រួលដោយលោកមេធាវី អ៊ីវ ប៉ូលី និងប្រធានបទទី៣ «នីតិវិធីក្នុងការស្រាវជ្រាវទ្រព្យសម្បត្តិរបស់កូនបំណុល» សម្របសម្រួលដោយលោកមេធាវី ហួយ តុងគីន។ ក្រោយបញ្ចប់បទបង្ហាញប្រធានបទពិភាក្សាទាំងបី អ្នកចូលរួមទាំងអស់នឹងអញ្ជើញទៅបន្ទប់ពិភាក្សា ដើម្បីចូលរួមមតិយោបល់លើកិច្ចពិភាក្សាលើប្រធានបទនីមួយៗ។

Seminar “Reviewing and Consulting on the Draft Land Law (New)”

On the morning of Tuesday, 28th April 2026, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia, appointed Attorney IV Poly, Member of the Bar Council, to deliver remarks at the opening of the seminar on “Reviewing and Consulting on the Draft Land Law (New).” The seminar was held under the high presidency of H.E. SAY Samal, Deputy Prime Minister and Minister of Land Management, Urban Planning and Construction, with the participation of the Ministry’s leaders, representatives of the Bar Association, and approximately 460 lawyers and land registration officials. In his remarks, Attorney IV Poly highlighted the Memorandum of Understanding between the Ministry of Land Management, Urban Planning and Construction and the Bar Association of the Kingdom of Cambodia, signed on 4th April 2025, which established a dedicated working group of the Bar Association to provide feedback on the draft Land Law (new). Under this framework, the working group has already reviewed and provided comments on several parts of the draft law, identifying a number of complex issues that require further clarification and discussion, which were selected as key topics for this seminar. In his opening address, the Deputy Prime Minister emphasized the importance of revising the Land Law to keep pace with social developments, noting that it must carefully balance political, social, and economic considerations. He further stated that the new law should be sufficiently robust and practical to ensure effective implementation within the Cambodian context. He added that the draft law represents an update based on past experiences and implementation challenges, incorporating relevant sub-decrees and regulations into a more coherent legal framework to improve consistency and effectiveness in land management in the future. The seminar also featured a presentation on the draft Land Law (new) by H.E. THENG Chan Sangvar, Secretary of State of the Ministry, along with three thematic discussion sessions:

1. “Registration of Ownership – Cases of Common Property,” moderated by Attorney TEP Bophal;

2. “Registration of Immovable Property Based on Court Decisions,” moderated by Attorney IV Poly;

3. “Procedures for Investigating Debtor’s Assets,” moderated by Attorney HUOY Tongkin. Following the presentations, participants were invited to join breakout discussions to exchange views and provide feedback on each topic.
