វេទិកាបរធនបាលកិច្ច ឆ្នាំ២០២៦

នាថ្ងៃអង្គារ ៦រោច ខែទុតិយាសាឍ ឆ្នាំមមី អដ្ឋស័ក ព.ស.២៥៧០ ត្រូវនឹងថ្ងៃទី៤ ខែសីហា ឆ្នាំ២០២៦ លោកមេធាវី សាំង វណ្ណៈ ប្រធានគណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា បានចាត់តាំងក្រុមការងារគណៈមេធាវីចូលរួមវេទិកាបរធនបាលកិច្ច ឆ្នាំ២០២៦ ដែលរៀបចំដោយនិយ័តករបរធនបាលកិច្ច ក្រោមអធិបតីភាពដ៏ខ្ពង់ខ្ពស់ ឯកឧត្ដមអគ្គបណ្ឌិតសភាចារ្យ អូន ព័ន្ធមុនីរ័ត្ន ឧបនាយករដ្ឋមន្រ្តី រដ្ឋមន្រ្តីក្រសួងសេដ្ឋកិច្ចនិងហិរញ្ញវត្ថុ និងជាប្រធានក្រុមប្រឹក្សាអាជ្ញាធរសេវាហិរញ្ញវត្ថុមិនមែនធនាគារ។ វេទិកាបរធនបាលកិច្ច ជាវេទិកាប្រចាំឆ្នាំរបស់និយ័តករបរធនបាលកិច្ច ដោយនៅក្នុងឆ្នាំ២០២៦ នេះ ត្រូវបានរៀបចំក្រោមមូលបទ «បរធនបាលកិច្ចក្នុងជវភាពនៃប្រព័ន្ធតួអង្គតែមួយ និងសមិទ្ធផលក្នុងរយៈពេល ៥ឆ្នាំ» និងមានការរៀបចំឱ្យមានកិច្ចពិភាក្សាលើប្រធានបទពាក់ព័ន្ធចំនួន៤គឺ៖

-គម្រោងអភិវឌ្ឍខេត្តប៉ូលសេដ្ឋកិច្ចសំខាន់ៗ និងយន្តការបរធនបាលកិច្ចក្នុងក្របខណ្ឌគោលនយោបាយទាក់ទាញការវិនិយោគមកកម្ពុជា

-ការបង្កើតបរធនបាលកិច្ចគ្រួសារក្នុងបរិបទសង្គមកម្ពុជា

-ការគ្រប់គ្រងហានិភ័យនិងកិច្ចគាំពារវិនិយោគិនក្នុងវិស័យបរធនបាលកិច្ច

-ការចាប់យក និងប្រើប្រាស់បច្ចេកវិទ្យាហិរញ្ញវត្ថុក្នុងវិស័យបរធនបាលកិច្ច ក្នុងចំណោមប្រធានបទទាំងបួននេះ គណៈមេធាវីនៃព្រះរាជាណាចក្រកម្ពុជា ក៏បានចូលរួមជាវាគ្មិនលើប្រធានបទ «ការបង្កើតបរធនបាលគ្រួសារក្នុងបរិបទសង្គមកម្ពុជា» ដោយមានលោកស្រីមេធាវី ទេព បូផល ប្រធាននាយកដ្ឋានស្រាវជ្រាវ បោះពុម្ព និងផ្សព្វផ្សាយ ជាតំណាង។ គួរបញ្ជាក់ថា បរធនបាលកិច្ចគ្រួសារ ជាសញ្ញាណមួយនៃបរធនបាលកិច្ច ដែលត្រូវបានបង្កើតឡើងក្នុងគោលបំណងការពារ និងគ្រប់គ្រងទ្រព្យសម្បត្តិសម្រាប់គ្រួសារតជំជាន់ ដែលអ្នកទទួលផលប្រយោជន៍ គឺជាសមាជិកគ្រួសារ ដោយសញ្ញាណនេះត្រូវបានអនុវត្តនៅបណ្តាប្រទេសជាច្រើនលើសកលលោក ហើយកម្ពុជាបាននិងកំពុងរៀបចំឱ្យមានការអនុវត្តយន្តការនេះដើម្បីសម្របសម្រួលដល់ការគ្រប់គ្រងទ្រព្យសម្បត្តិរបស់គ្រួសារ ក៏ដូចជាការរីកចម្រើននៃវិស័យបរធនបាលកិច្ចនៅកម្ពុជា។ កិច្ចពិភាក្សានេះ ត្រូវបានរៀបចំក្នុងគោលបំណងពិភាក្សាអំពីយន្តការផ្លូវច្បាប់ និងការអនុវត្តពាក់ព័ន្ធនឹងបរធនបាលកិច្ចគ្រួសារនៅកម្ពុជា តាមរយៈនេះតំណាងគណៈមេធាវី បានចែករំលែកនូវមូលដ្ឋានគតិយុត្តពាក់ព័ន្ធនឹងការបង្កើតបរធនបាលកិច្ចគ្រួសារក្នុងបរិបទកម្ពុជា ដោយធ្វើការបង្ហាញពីទំនាក់ទំនងរវាងច្បាប់ស្តីពីបរធនបាលកិច្ច និងបទប្បញ្ញតិ្តពាក់ព័ន្ធនឹងសន្តតិកម្មក្នុងក្រមរដ្ឋប្បវេណី ដូចជាការបែងចែករវាងបរធន និងទ្រព្យសន្តតិកម្ម ទំនាក់ទំនងរវាងលិខិតបរធនបាលកិច្ច និងមតកសាសន៍​ ជាអាទិ៍។

Trust Forum 2026

On Tuesday, 4th August 2026, Attorney SAING Vannak, President of the Bar Association of the Kingdom of Cambodia (BAKC), designated a BAKC delegation to participate in the Trust Forum 2026, organized by the Trust Regulator under the high presidency of H.E. Akka Pundit Sopheacha AUN Pornmoniroth, Deputy Prime Minister, Minister of Economy and Finance, and Chairman of Non-Bank Financial Services Authority Council. The Trust Forum is an annual event organized by the Trust Regulator. This year's forum was held under the theme "Trusts in the dynamics of stakeholder system and achievements over the past five years." The forum featured panel discussions on four key topics: - Development projects for key economic pole provinces and the role of trust mechanisms within Cambodia's investment attraction policy framework.

- Establishing family trusts in the Cambodian social context.

- Risk management and investor protection in the trust sector.

- Adoption and application of financial technology in the trust sector. Among these four topics, the Bar Association of the Kingdom of Cambodia participated as a panel speaker on "Establishing Family Trusts in the Cambodian Social Context," represented by Attorney TEP Bophal, Director of the Department of Research, Publication and Dissemination. It is worth noting that a family trust is a form of trust established to protect and manage family assets across generations, with family members serving as the beneficiaries. This legal mechanism has been widely adopted in many countries around the world. Cambodia is currently developing and implementing this mechanism to facilitate family asset management while promoting the growth of the trust sector in the Kingdom. The discussion was organized to examine the legal framework and practical implementation of family trusts in Cambodia. During the session, the BAKC representative shared legal perspectives on the establishment of family trusts within the Cambodian context, highlighting the relationship between the Law on Trusts and the provisions on succession under the Civil Code, including the distinction between trust property and inherited property, as well as the relationship between a trust instrument and a will, among other related issues.
